1. Acceptance of Terms

By accessing https://mmahingu.com/github-backup-manager/, purchasing a software license, or downloading and executing GitHub Backup Manager and its Local Companion engine, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase, download, or use the software.

These Terms constitute a binding legal agreement between you ("Customer", "User", or "Licensee") and Mehtab Singh Mahingu ("Creator", "Licensor", or "we/us"), trading through https://mmahingu.com.

2. Software Classification & Product Nature

GitHub Backup Manager (GitHub Backup Manager) is classified as a Developer Productivity Utility & Digital Good. It is an independent desktop application and browser-based control console designed for developer workflow preservation, incremental snapshot archival, and 1:1 offline vault viewing of Git repositories.

Non-Hosting Declaration: GitHub Backup Manager is NOT a cloud hosting service, VPS, VPN, proxy network, or cloud storage drive. All Git cloning, media scraping, and archive files are written strictly to local storage media specified by the user on their own personal computer.

Dual-Mode Technical Architecture & Client-Side Delivery: The software is engineered to operate via two user-selected interfaces: (a) the primary Local Workstation Dashboard executing natively on local loopback (http://127.0.0.1:4242/), and (b) the hosted Web Control Tower at mmahingu.com. Because third-party web browser extensions (including adblockers, content filters, and browser-specific Private Network Access security heuristics) intentionally block public cloud web pages from querying local PC ports, any client-side blocking between mmahingu.com and 127.0.0.1 does NOT constitute a software defect, technical outage, or failure of service delivery. Complete, unrestricted functionality is permanently accessible by navigating directly to the local companion dashboard at http://127.0.0.1:4242/.

3. License Grant & Permitted Use

Every paid usage pass token grants complete and identical access to all features and capabilities of GitHub Backup Manager without restriction or feature withholding. The sole distinction between usage pass tiers is the repository limit and active time window:

• 24-Hour Pass: Up to 10 repositories with unlimited resyncs during the 24-hour window from the moment of activation. Full access to all features.
• 48-Hour Sprint: Up to 50 repositories with unlimited resyncs during the 48-hour window from the moment of activation. Full access to all features.
• 28-Day Pro: Unlimited repositories with unlimited resyncs for the entire 28 days. Full access to all features.
• Annual License: Unlimited everything until the exact same date of the following calendar year (with purchases on February 29 honored through March 1 of the following year). Full access to all features.

You may install and execute the Local Companion engine on your personal workstations and development environments for personal and internal commercial engineering workflows. You may not redistribute, resell, sub-license, reverse-engineer, decompile, or publicly host the proprietary companion batch engine without express written consent from Mehtab Singh Mahingu.

4. GitHub Acceptable Use Policies & API Terms Compliance Guarantee

GitHub Backup Manager is deliberately architected to guarantee 100% compliance with GitHub's Terms of Service, REST API Guidelines, and Acceptable Use Policies:

• Standard Git CLI Execution: All code tree synchronization and repository checkouts use standard, official git.exe commands (git clone, git fetch, git checkout) over standard HTTPS endpoints. The software operates identically to standard command-line developer workflows.
• Bring-Your-Own-Key (BYOK): Users supply their own GitHub Personal Access Token (PAT) or authenticate via official OAuth device authorization. Tokens are stored exclusively on the user's local operating system and are never transmitted, logged, or shared with mmahingu.com or any third party.
• Strict Rate-Limit Throttling: The software strictly honors GitHub rate limits (60 requests/hr for unauthenticated IP queries, 5,000 requests/hr for authenticated tokens). Built-in client throttles and exponential backoff prevent aggressive request bursts.
• No Scraping or Bypass of Gated Data: GitHub Backup Manager does NOT bypass CAPTCHAs, paywalls, or privacy boundaries. It only accesses repositories the user already has lawful, authenticated permissions to view or download.
• Zero Cloud Storage (0 MB Stored): All cloned source code, commits, wiki repositories, and release assets stream directly into the user's local hard drive vault. Zero megabytes of user code are uploaded, mirrored, or cached on web servers.
• Fair-Use Archival & Preservation: The software is engineered strictly as a personal repository archival and offline preservation utility. It does not re-publish, index, resell, or commercially redistribute third-party GitHub repository code or user metadata.

5. Intellectual Property Rights

The GitHub Backup Manager software, web control tower, user interface, brand assets, and documentation are the exclusive intellectual property of Mehtab Singh Mahingu. All rights not expressly granted herein are reserved.

GitHub Backup Manager is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While GitHub Backup Manager incorporates defensive SHA-256 integrity verification, safe file handling, and granular sync safeguards, the Licensor shall not be liable for any data loss, API rate limit exhaustion, or hardware faults resulting from third-party repository states or system configurations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Mehtab Singh Mahingu or mmahingu.com be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with your use or inability to use the software. The total liability for any claims under these Terms shall not exceed the actual amount paid by you for the software license.

9. Payments, Billing & Merchant of Record

All payments, order processing, and tax remittance are processed securely by Dodo Payments as our Merchant of Record. By purchasing, you agree to Dodo Payments' customer checkout terms. License fees are pre-paid and non-recurring. Because digital software delivery begins immediately, refunds are governed strictly by our objective 2-hour dual-tier verification criteria: (a) unused keys with zero (0) repository downloads requested within 2 hours of purchase, or (b) verified technical engine failures with zero completed repository downloads and no more than two attempts requested within 2 hours of purchase. 10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Punjab, India.
